Terms of Service
Last updated: [DATE]. Company legal name: [COMPANY LEGAL NAME], [ADDRESS].
These terms govern your use of Saywell's website, Shopify app and related services (the "Service"). By installing or using the Service you agree to them on behalf of your business.
1. The Service
Saywell creates personalized voice messages in a voice you provide, which the merchant reviews and approves before they are sent to customers (for example through the merchant's email or SMS tools).
2. Your account
You must be authorized to act for the store you connect. You are responsible for activity under your account and for keeping access secure.
3. Your voice and content
- You confirm that any voice you upload is your own, or that you have the speaker's written permission to clone it for your store's messages.
- You keep ownership of your recordings, scripts and customer data. You grant us a limited license to use them only to provide the Service to you.
- You approve your voice model and scripts before messages are sent.
4. Consent and compliance
- You are responsible for having a lawful basis and any required consent to contact your customers, including written consent for prerecorded or AI voice messages where required (for example under the US TCPA).
- You will not use the Service for deceptive messages, impersonation, harassment or unlawful marketing.
- We may block, pause or refuse sends that lack a consent record or that we reasonably believe break the law or these terms.
5. Plans, usage and spending cap
The service is free during early access. If we introduce paid plans, we will tell you before anything is charged, and charges will be billed through Shopify Billing.
6. Acceptable use
No reverse engineering, abuse of the Service, attempts to access other merchants' data, or use that violates Shopify's terms.
7. Availability and changes
We work to keep the Service available but do not guarantee it will be uninterrupted. We may change features with reasonable notice.
8. Disclaimers and liability
The Service is provided "as is". To the fullest extent permitted by law, our total liability is limited to the amounts you paid us in the [12] months before the claim. [Counsel: complete warranty disclaimer, indemnity and limitation clauses.]
9. Termination
You can uninstall at any time. We may suspend or end access for breach of these terms. On termination we delete your data as described in our Privacy Policy.
10. Governing law
[Jurisdiction and venue to be confirmed.]
